Acceptance of Terms
By accessing or using the website at getchairapp.com, the The Chair mobile app, or any related services (together, the "Service"), you agree to be bound by these Terms & Conditions (the "Terms") and by our Privacy Policy. If you don't agree, please don't use the Service.
These Terms form a legally binding agreement between you and 1001646125 Ontario Incorporated (referred to below as "we," "us," or "The Chair").
Who we are
The Chair is a technology platform that helps clients discover independent barbers through portfolios, reviews and profile pages, and that lets clients continue to the barber's preferred booking system to schedule appointments.
- Legal name: 1001646125 Ontario Incorporated
- Doing business as: The Chair / The Chair App
- Jurisdiction: Province of Ontario, Canada
- Contact: info@getchairapp.com
Eligibility & accounts
To use The Chair you must:
- Be at least 16 years old (or older, where required by law)
- Have the legal capacity to enter into a binding contract
- Not be barred from using the Service under applicable law
To create an account you'll provide accurate information and keep it up to date. You're responsible for all activity on your account and for keeping your credentials secure. Notify us right away if you suspect unauthorised use.
You may have one active account per role (one Client account and, if applicable, one Barber account). We may refuse, suspend, or delete accounts at our discretion.
Our role in the marketplace
The Chair is a marketplace. We help barbers list their services and help clients discover and connect with them. We are not the provider of grooming or barbering services.
Where a booking or appointment is arranged through The Chair, the contract for the service itself is between the client and the barber — not with The Chair. We are not a party to any client-barber agreement.
Many bookings are completed on the barber's preferred third-party platform (such as Booksy, Fresha, Vagaro, Square, or the barber's own website). Once you leave The Chair to complete a booking on one of those platforms, that platform's terms and privacy policy apply.
Client terms
As a client, you agree to:
- Provide accurate booking information
- Show up on time, or cancel/reschedule per the barber's stated policy
- Pay the agreed price directly to the barber (or through the barber's booking platform)
- Treat barbers with respect at all times
The Chair is free for clients. We don't add booking fees or surge pricing.
Cancellations, refunds, and no-show fees are handled by the barber's own policy, which you can see on their profile or booking page before you confirm.
Barber terms
As a barber, you agree to:
- Hold any professional licences, permits, and insurance required to lawfully provide barbering services in your jurisdiction
- Comply with all applicable health, hygiene, sanitation and business regulations
- Provide accurate profile information, prices, service descriptions, and portfolio images that represent your own work
- Only upload content you own or have the right to use
- Fulfil confirmed bookings professionally and on time
- Handle client payments, taxes, and refunds directly with the client
- Communicate a clear cancellation policy and honour it
- Respect The Chair's prohibited conduct rules
You are an independent operator, not an employee, partner, or agent of The Chair. Nothing in these Terms creates an employment, joint venture, or agency relationship.
You keep 100% of what your clients pay you. The Chair does not take booking commissions.
Fees, payments & subscriptions
Clients
The Chair is free to use for clients. You pay the barber directly (in person or via the barber's booking platform). We don't add fees or take a cut.
Barbers
Barber subscriptions are CAD $20 per month (or the price displayed on your subscription page at the time of purchase). Founding barbers may receive promotional pricing (e.g. first months free) — the specific terms will be shown at sign-up.
- Subscriptions renew automatically each month until you cancel
- Cancellations take effect at the end of the current billing cycle
- Fees are non-refundable, except where required by law or where we choose to make an exception
- Prices may change; we'll give you at least 30 days' notice before any price change affects you
- Applicable taxes (HST/GST/QST) will be added at checkout
Payments are processed by a third-party payment processor. By subscribing you also agree to that processor's terms.
Reviews & user content
Reviews, photos, portfolios, comments, messages and anything else you post on The Chair are "User Content". You keep ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, display, reproduce, translate and distribute it as necessary to operate and promote the Service.
You represent that your User Content:
- Is yours, or you have the rights to share it
- Is truthful and not misleading
- Doesn't violate any law or third-party rights
We may remove User Content that violates these Terms or our community guidelines. We don't proactively moderate every post, but we act on reports.
Reviews: reviews should reflect your genuine, first-hand experience. Fake reviews, review swapping, incentivised reviews, and reviews from parties with a conflict of interest are not allowed.
Prohibited conduct
You agree not to:
- Break any law, or use the Service to break any law
- Harass, threaten, discriminate against, or abuse other users or staff
- Post content that is illegal, hateful, sexually explicit, violent, defamatory, deceptive, or infringes intellectual property or privacy rights
- Impersonate another person or business
- Scrape, copy, or extract large portions of the Service or User Content without our written consent
- Reverse-engineer, decompile, or otherwise attempt to derive source code from the Service
- Interfere with, disrupt, or attack the Service or its infrastructure
- Circumvent our fees or use the Service to make bookings outside of the barber's stated booking flow in ways that harm the barber or The Chair
- Post fake reviews, buy reviews, or manipulate ratings
- Use the Service for anything other than its intended purpose
Violations can result in warnings, content removal, suspension, or permanent termination — plus legal action where appropriate.
Intellectual property
The Chair — including our name, logo, website, app, design, code, and all related content that isn't User Content — is owned by us or our licensors and protected by copyright, trademark and other laws.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for its intended purpose.
All rights not expressly granted are reserved.
Third-party services
The Service links to and integrates with third-party services (like Booksy, Fresha, Vagaro, Instagram, Stripe, Google, Apple). We don't control those services and aren't responsible for their content, availability, or practices. Your interactions with them are subject to their own terms and privacy policies.
Termination
You can stop using the Service and delete your account at any time — visit getchairapp.com/account-deletion/ or use the in-app option. Barbers can cancel their subscription from the Subscription page in the barber app.
We can suspend or terminate your account, remove content, or restrict features if we believe you've breached these Terms or if we're required to do so by law. Where practical, we'll give notice — but in urgent cases (fraud, safety, security) we may act first and explain later.
Sections that by their nature should survive termination — including sections 8, 10, 13, 14, 15, and 16 — will continue to apply after your account ends.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
We don't warrant that any barber listed on The Chair will meet your expectations, or that any specific outcome will result from using the Service. Barbering services are provided by independent professionals; we don't guarantee their skill, availability, pricing or conduct.
Some jurisdictions don't allow certain disclaimers. In those places, our disclaimers apply only to the extent permitted by law.
Limitation of liability
To the fullest extent permitted by law:
- The Chair and its officers, directors, employees and agents are not liable for indirect, incidental, special, consequential, punitive or exemplary damages — including loss of profit, goodwill, or data — arising out of or related to your use of the Service, even if we've been advised of the possibility.
- Our total aggregate liability for any and all claims arising out of or relating to the Service is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $100.
These limits apply whether the claim is based on contract, tort, statute, or any other legal theory.
Indemnification
You agree to defend, indemnify and hold harmless The Chair and its officers, directors, employees and agents from any claim, loss, damage, liability, cost or expense (including reasonable legal fees) arising out of:
- Your use of the Service
- Your breach of these Terms
- Your violation of any law or third-party right
- Your User Content
- For barbers: your provision of services to clients
Governing law & disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws principles.
Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the courts located in Toronto, Ontario. You consent to their personal jurisdiction and venue.
If you're a consumer resident in a jurisdiction whose local law grants you additional rights that cannot be overridden by contract, nothing in these Terms limits those rights.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we'll notify you by email or through the app before they take effect. Continued use of the Service after the changes take effect means you accept the updated Terms. If you don't accept them, please stop using the Service.
